Is Apple abusing its dominant position in iTunes to promote its iPhone over Pre?

I believe Apple can prevail on this one. Rio, Creative and other music players license the right to be recognized with a unique player id in iTunes.

Palm chose not to go that route but instead to have the Pre falsely report itself to iTunes as an Apple iPod.
At the end of the day, the Pre's brief time in the sun won't be enough to draw much attention to this issue.
